Tarun Tejpal Convicted in Rape Case: On Thursday, the Bombay High Court in Goa annulled the earlier decision of the trial court from 2021 and convicted Tarun Tejpal, who is 61 and was the former editor of Tehelka magazine, of raping a junior colleague at the ThinkFest conference in 2013 at a five-star hotel in Goa.

The judges Neela Gokhale and Amit Jamsandekar sentenced Tejpal to ten years' rigorous imprisonment and a fine of ₹5 lakh pursuant to Section 376 of the IPC.

He was also fined ₹10,000 and sentenced to one year's rigorous imprisonment under Section 354(A) and three years' rigorous imprisonment under Section 354(B).

Former Tehelka editor Tarun Tejpal will serve all the sentences concurrently, meaning he will spend a total of 10 years in prison. He has four weeks in which to appeal to the Supreme Court.

He was prosecuted under a number of sections of the Indian Penal Code, such as sections 376 (rape), 354A (sexual harassment), 354B (criminal assault with the intention of disrobing a woman), 341 (wrongful restraint), and 342 (wrongful confinement).

In May 2021, the fast-track court in Goa acquitted Tejpal of the charges of rape and sexual assault.

Tarun Tejpal Latest News: The case received national attention, particularly in the light of the 2012 Delhi bus rape and murder, which caused great public anger and, as a result, led to more stringent laws being introduced to deal with crimes against women.

The Tejpal case also gave rise to a discussion regarding workplace harassment of women and the fact that such incidents are often not reported because of fears of losing their jobs or suffering retaliation.

Additional Sessions Judge Kshama Joshi acquitted Tejpal, who maintained that he had been falsely accused of sexual assault; the judge granted him the benefit of the doubt on the grounds that there was insufficient evidence.

During the trial, the CCTV footage from the hotel elevators was examined.

Tejpal stated that he had been framed and described the event as "an unfortunate incident" in a leaked 2013 email he sent to Tehelka's management. In that email, he called it "a bad lapse of judgment".

Although the trial began in September 2017, it was postponed when Tejpal contested the charges in the High Court and the Supreme Court.

The Supreme Court required that the trial be completed by December 2020, but the deadline was postponed due to the COVID-19 pandemic.

2013 Rape Case: The trial restarted in 2019 and has run every day since 2020. The prosecution claimed that Tejpal raped the complainant in the hotel lift on 7 November 2013 and had then attempted to assault her again the following day.

The prosecution challenged the verdict of acquittal, stating that the complainant had been treated as though she were on trial rather than Tejpal.

Solicitor General Tushar Mehta noted that her testimony had been used against her and referred to certain sections of the cross-examination.

Tarun Tejpal Convicted in Rape Case: The Goa Police claimed that the trial court had disregarded the survivor's testimony, even though she had given a clear and detailed description of the sexual harassment, rape, assault, use of force, and wrongful restraint and confinement.

The state maintained that the trial court had not believed the complainant's version of events because of preconceptions regarding the behaviour of a victim in the course of a sexual assault.

The prosecution referred to CCTV footage, photographs, WhatsApp messages, emails, and witness statements, and argued that the complainant had continued to participate in the ThinkFest events and had attended social functions.

The defence, on the other hand, said that the complainant had contacted Tejpal and invited him to join her for a photograph with Hollywood actor Robert De Niro.

They contended that this did not support the prosecution's assertion that she was afraid of him and was trying to avoid him.
